Trademark Classifications

There are different types of business and profession throughout the world. Thus in order to characterize each and every profession the government of India has described and interpreted each and every profession or business in different classes. There are altogether forty two classes in India concerning trademark matters, out of which first thirty four speaks of business pertaining to manufacture or trading of goods and thirty five to fourty two relates to services provided by individuals, firms, company, association and various other agencies. Thus all goods and services shall fall within these fourty classes and if there is any confusion pertaining to the class or category, than the opinion of the Registrar can be taken in this regard. The Indian Trademark classification has its roots in the Nice classification.

International Trademark Classification



International Trademark classification has been structured on the basis of Nice Classification. The Nice Classification mainly consists of classification of goods and services for the purposes of registering trademarks and service marks throughout the world. Under the Nice classification there are mainly fourty five classes with first thirty four speaking of goods and the rest describing services provided by various individuals and firms of the world. Thus compared to Indian classification of trademarks which determines the goods and services within fourty two classes, trademarks under international classification are interpreted in fourty five classes. However till January, 2009 eighty three states have become member of the Nice agreement and apart from these they have also adopted the Nice classification for registration of marks in their respective countries.
